Washington, D.C. attorney-advertising rules every law firm marketer must follow

The District of Columbia takes a permissive, content-based approach to attorney advertising that closely tracks the ABA Model Rules. Unlike Florida and Texas, DC does not require pre-approval filing or submission of advertisements to the bar; instead, it subjects all lawyer communications solely to a prohibition on false or misleading statements. DC's advertising rules are consolidated entirely within Rule 7.1, with no separate Rules 7.2–7.5.

False or misleading communications

Rule 7.1(a)

A lawyer shall not make a false or misleading communication about the lawyer or the lawyer's services; a communication is false or misleading if it contains a material misrepresentation of fact or law, omits a fact necessary to make the statement not materially misleading as a whole, or contains an assertion about the lawyer or services that cannot be substantiated.

In-person solicitation restrictions

Rule 7.1(b)

A lawyer shall not seek by in-person contact employment by a nonlawyer who has not sought the lawyer's advice regarding employment if the solicitation involves false/misleading statements, coercion/duress/harassment, or targets a potential client in a physical or mental condition making reasonable judgment unlikely.

Prohibited payments for recommendations

Rule 7.1(c)

A lawyer shall not pay money or give anything of material value to a person for recommending the lawyer's services, except the lawyer may pay reasonable costs of permitted advertisements, legal service plan fees, law practice purchases per Rule 1.17, or reciprocal referral agreements that are not exclusive and where the client is informed.

Assistance with organizational promotion

Rule 7.1(d)

A lawyer shall not knowingly assist an organization that furnishes or pays for legal services to promote the lawyer's services as a private practitioner if the promotional activity involves coercion, duress, compulsion, intimidation, threats, or vexatious or harassing conduct.

Courthouse solicitation prohibition

Rule 7.1(e)

No lawyer or person acting on behalf of a lawyer shall solicit any person for fee-paid representation in any case in the District of Columbia Courthouse, on the courthouse sidewalks (north, south, west sides), or within 50 feet of the east side building; exception for pro bono representation.

Incarcerated person solicitation notice

Rule 7.1(f)

Any lawyer who solicits an incarcerated person at the D.C. Jail, Correctional Treatment Facility, or D.C. juvenile detention facility for fee-paid representation in a then-pending case must provide timely and adequate notice to the person's current lawyer prior to accepting any fee from the incarcerated person.
